Terms of Use

These terms are an agreement between you and Caitty ("we", "us") covering your use of the Travely iOS app. By installing or using Travely you accept them. If you do not accept them, do not use the app.

1. What Travely Is

Travely is an entertainment and role-playing app. Everything in it is fictional:

• Companions are AI-generated characters. They are not real people, not depictions of real people, and not human beings you are talking to.
• Every destination image is AI-generated. Images are inspired by real places, but they are not photographs of those places and should not be treated as accurate depictions.
• Companion replies, including guide commentary, are produced by a language model and may be inaccurate, incomplete or invented.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Travely on Apple devices you own or control, for personal, non-commercial purposes. You may not copy, modify, reverse-engineer, decompile, resell, sublicense or redistribute the app or its content, including its generated images and written material.

3. Eligibility

You must be at least 17 years old, or the minimum age required in your country, to use Travely. By using it you confirm you meet that requirement.

4. Stars, Purchases and Subscriptions

• Stars are a virtual in-app currency with no monetary value. They cannot be exchanged for money, transferred between devices or accounts, or redeemed outside the app.
• Text chat is free. Stars unlock destinations and companions and pay for voice replies and live calls. You also earn stars from a daily bonus and from check-ins.
• Star packs are one-time purchases. Once the stars are credited, the purchase is consumed.
• Premium is an auto-renewing subscription offered monthly or yearly. It grants a star allowance on each renewal and a doubled daily bonus. It does not waive the star cost of voice replies or live calls. It renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel it in your Apple ID subscription settings — we cannot cancel it for you.
• All payments are processed by Apple under Apple's terms. Refunds are handled by Apple at their discretion; we do not process refunds directly.
• Stars and unlocked content are stored on your device. Resetting your trip, deleting the app or losing the device will lose them, and we cannot restore them. Restoring purchases restores an active subscription, not a consumed star balance.
• We may change prices, star costs and what stars buy. Changes apply going forward and never retroactively remove stars you already hold.

5. Acceptable Use

You agree not to:

• Use Travely for anything unlawful, or to generate content that is illegal, sexual content involving minors, harassing, hateful, or that incites violence.
• Attempt to make a companion impersonate a specific real, identifiable person.
• Probe, disrupt, overload, scrape or abuse the service or its underlying providers, or attempt to bypass star costs, rate limits or content safeguards.
• Present AI-generated destination images as real photographs, or companion output as factual reporting.

We may suspend access to server features if the service is being abused.

6. Content and Sharing

Conversations, your travel history and any profile details you enter are stored on your device. When you use a share button, you choose what leaves the app and where it goes; you are responsible for what you share. Do not enter information into the app that you would not want to appear in a conversation sent to an AI model for a reply.

7. Availability

Browsing, travelling and your passport map work offline. Live conversation, voice replies and calls require an internet connection and depend on third-party providers. We provide the service "as is" and do not guarantee it will be uninterrupted, error-free, or available in every country. Features may change or be withdrawn.

8. Disclaimer and Liability

To the fullest extent permitted by law, Travely is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, virtual currency or unlocked content. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits rights you have under mandatory consumer law in your country.

9. Termination

You may stop using Travely at any time by deleting the app. We may suspend or terminate access if these terms are breached. Sections that by their nature should survive termination — licence restrictions, disclaimers, liability limits and governing law — do so.

10. Changes to These Terms

We may update these terms. The date at the top of this page will change, and continuing to use the app after an update means you accept the revised terms.

11. Apple App Store — Additional Terms

• These terms are between you and Caitty only, not Apple. Apple is not responsible for Travely or its content.
• Apple has no obligation to provide maintenance or support for Travely.
• If Travely fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim relating to Travely, including product liability, legal or regulatory non-compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which Caitty operates, without regard to conflict-of-law rules, and without limiting mandatory consumer protections available to you where you live.
