Terms of Use

These Terms are an agreement between you and Caitty (“we”, “us”) governing your use of the oTranslate iOS app, translation extension, online services and website. By downloading or using oTranslate, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

1. What oTranslate Provides

oTranslate is a language utility that can display system on-device translation, request translations from online engines, and use AI to translate, explain, summarize, revise or answer questions about text and user-selected images. Features and language availability depend on your device, iOS version, network, installed language resources and third-party providers.

Translation and AI output can be wrong. Do not rely on oTranslate as the sole basis for medical, legal, financial, immigration, safety-critical or other high-stakes decisions. Have a qualified person review important text.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use oTranslate on Apple devices you own or control for lawful personal or internal business purposes, subject to these Terms and Apple’s usage rules. You may not resell, sublicense, reverse-engineer, decompile, disrupt or create an unauthorized derivative of the app or service except where applicable law expressly permits it.

3. Eligibility

You must be legally capable of accepting these Terms. If you are under the age of majority where you live, a parent or legal guardian must authorize your use. oTranslate is not directed to children under 13 or the equivalent minimum age in your country.

4. On-Device and Online Features

On-device translation uses Apple system technology. Supported language pairs and downloaded resources are determined by Apple and can change with iOS.
Online and AI features require an internet connection and depend on our service and third-party model or translation providers.
Photo questions process the image you choose and the question you send. You must have the right to submit the image.
Reference information from services such as Wikipedia may be incomplete, outdated or unavailable.

5. Stars

Stars are a virtual in-app balance used for optional AI operations. They have no cash value, cannot be exchanged for money, and cannot be transferred, sold or used outside oTranslate.

A standard text AI operation normally costs one Star.
A question containing an attached photo costs five Stars.
Engine prices and promotional rewards may vary and are displayed or configured in the app.
A failed charged request is eligible for an automatic in-app refund when the app detects that no answer was produced.
Purchased Star packs are consumable. Apple may not restore consumed virtual currency, and deleting the app or its local data can remove the balance.
Optional rewarded videos may grant Stars after the ad provider confirms completion. Ad availability is not guaranteed.

6. Premium Subscriptions

oTranslate Premium is available as weekly, monthly and yearly auto-renewing subscriptions. Premium removes advertising while the subscription is active and grants a finite number of Stars for each newly verified subscription purchase or renewal. Premium does not provide unlimited Stars or unlimited AI operations.

The weekly plan grants 100 Stars per verified transaction, the monthly plan grants 500 Stars, and the yearly plan grants 6,000 Stars.
Each App Store subscription transaction is credited once. Reopening the app or restoring the same transaction does not issue the grant again; a newly verified renewal transaction can issue the next grant.
Granted Stars are consumed at the same feature prices as purchased or rewarded Stars and have no cash value.
Payment is charged to your Apple Account when you confirm purchase.
The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
Your Apple Account is charged for renewal within 24 hours before the current period ends at the price shown by Apple.
You can manage or cancel Premium in your Apple Account subscription settings. Deleting oTranslate does not cancel a subscription.
If a free trial or introductory offer is shown by Apple, unused portions end when you purchase another subscription where applicable.
Prices, taxes and currencies are determined by the App Store storefront and may differ from fallback prices displayed when StoreKit data is unavailable.

Restoring purchases restores an active ad-free subscription entitlement. It does not duplicate the Star grant for a transaction already credited, recreate Stars already spent, or restore local history deleted from the device.

7. Acceptable Use

You agree not to use oTranslate to:

Violate law, intellectual-property rights, privacy rights or contractual duties.
Submit an image, document or personal information you are not authorized to process.
Generate, facilitate or distribute child sexual abuse material, unlawful threats, targeted harassment, fraud, malware or instructions for violent wrongdoing.
Probe, scrape, overload, automate abuse of, or bypass authentication, rate limits, Star charges, content safeguards or purchase verification.
Misrepresent AI output as verified professional advice or a certified translation.

We may restrict access to online features when reasonably necessary to prevent abuse, protect the service or comply with law.

8. Your Content

You retain rights you have in text and images you submit. You grant us and our service providers a limited licence to transmit, reproduce and process that content solely as needed to provide, secure and troubleshoot the operation you request. You are responsible for the content you submit and for reviewing output before using or sharing it.

9. AI Output and Intellectual Property

AI output may be inaccurate, incomplete, offensive, similar to output produced for another user, or subject to third-party rights. We do not promise that output is unique or that you can claim exclusive rights in it. You are responsible for confirming accuracy and obtaining any permission required for your intended use.

10. Availability and Changes

The service is provided on an “as available” basis. We may add, change, suspend or remove engines, prices, language support, rewards or features. Network failures, model-provider outages, App Store issues and changes to iOS can interrupt service. We do not guarantee that every language pair, image or request will produce a result.

11. Refunds

Apple processes all payments. Requests for monetary refunds must be submitted to Apple and are governed by Apple’s policies and applicable law. In-app Star refunds for failed requests are limited to the balance charged for that request and are not a cash refund.

12. Disclaimers

To the maximum extent permitted by law, oTranslate and its services are provided without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability or accuracy. We do not warrant that a translation is certified, suitable for publication or safe for a particular professional use. Mandatory consumer rights that cannot legally be excluded remain unaffected.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, business, data or opportunity; or harm caused by reliance on translation or AI output. Where liability cannot be excluded, our aggregate liability relating to the service will not exceed the amount you paid for oTranslate in the twelve months before the event giving rise to the claim, subject to non-waivable consumer law.

14. Termination

You may stop using oTranslate at any time. We may suspend access to online features for a material breach, service abuse, legal requirement or security risk. Terms that logically survive termination—including payment obligations, licence restrictions, disclaimers, liability limits and dispute provisions—continue to apply.

15. Apple App Store Terms

These Terms are between you and Caitty, not Apple. Caitty, not Apple, is responsible for oTranslate and its content.
Apple has no obligation to provide maintenance or support for oTranslate.
If the app fails to conform to an applicable warranty, you may notify Apple; Apple may refund the app purchase price, if any, and has no other warranty obligation to the maximum extent permitted by law.
Caitty, not Apple, is responsible for addressing claims relating to the app, including product-liability, regulatory, consumer-protection and intellectual-property claims.
You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited or restricted parties list.
You must comply with applicable third-party terms when using oTranslate.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing Law

These Terms are governed by the laws applicable to Caitty’s place of operation, without regard to conflict-of-law principles, except that mandatory consumer protections and venue rights in your place of residence continue to apply where required.

17. Changes to These Terms

We may update these Terms to reflect changes in the app, providers or law. The new date appears at the top. Continuing to use oTranslate after revised Terms take effect means you accept them, to the extent permitted by law.
