Terms of Use (EULA)

These Terms of Use are the end user license agreement (EULA) for Groupy (package caitty.com.groupy), operated by Caitty. By installing or using the app you agree to them. If you do not agree, do not use the app. If you installed Groupy from the Apple App Store, section 12 also applies to you.

1. What Groupy Is

Groupy is an entertainment app. Every group member other than you is a fictional character generated by an AI language model. This includes characters based on historical and mythological figures: those are dramatisations written by a model, not the real person, not their estate, and not endorsed by anyone. Nothing a character says is verified, and it is not medical, legal, financial or psychological advice.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Groupy on devices you own or control, for your own non-commercial entertainment. You may not copy, sell, rent, sub-licence, modify or reverse-engineer the app, except to the extent that applicable law says you may.

3. Eligibility

You must be at least 13 years old, and old enough to agree to these Terms where you live. If you are under the age of majority, use Groupy only with a parent or guardian's permission.

4. Stars, Purchases and Subscriptions

• Stars are a virtual, in-app currency with no cash value. They cannot be exchanged for money, transferred between devices or accounts, or refunded by us.
• Stars pay for sending messages, playing voice notes, unlocking groups, creating groups and creating characters. Prices are shown in the app and may change.
• Premium is an auto-renewing subscription sold as a monthly or a yearly plan; the price and the period are shown in the app before you buy. It grants a monthly allocation of Stars and removes ads. Premium members still spend Stars on the actions listed above; the subscription is the monthly grant and the ad removal, not unlimited use.
• Payment is charged to your Apple Account or Google Play account at confirmation of purchase. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the current period ends, and renewal is charged within 24 hours before the period ends.
• Manage or cancel a subscription in your Apple Account settings or in Google Play at any time after purchase; cancelling takes effect at the end of the current period.
• All purchases are processed by Apple or Google under their terms. Refunds are handled by those stores, not by us.
• Deleting your data in the app destroys your Star balance permanently. That is not a refundable event.

5. Acceptable Use

You agree not to use Groupy to:

• Generate or solicit sexual content involving minors, or to present any character as a minor in a sexual context. This is an absolute limit and reports of it are actioned first.
• Generate content that promotes real-world harm, illegal activity, harassment, or hatred against a group of people.
• Impersonate a real living person in a way intended to deceive others, or to create content that defames a real person.
• Attempt to extract, reverse-engineer, disrupt or overload our backend services, or to bypass the Stars economy.
• Redistribute the app's generated audio or artwork as though it were your own commercial product.

We may block access to the service for conduct that breaks these rules.

6. Content You Create

Characters, groups, names, photos and messages you create stay on your device. You are responsible for anything you enter, including photos you supply — do not upload images you have no right to use, and do not upload photos of other people without their consent.

7. Reporting

Long-press any character message and choose Report to send it to moderation with a reason. We review reports and adjust the service's safeguards accordingly.

8. Availability

Groupy depends on third-party AI and speech services. Features may be unavailable, delayed or changed without notice. When a paid request fails to produce anything, the app refunds the Stars it charged.

9. Disclaimer and Liability

The app is provided "as is", without warranties of any kind. To the maximum extent permitted by law, Caitty is not liable for indirect, incidental or consequential damages arising from your use of the app, and our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits rights you have under consumer law that cannot be waived.

10. Termination

You may end this agreement at any time by deleting the app. We may suspend or end your access if you break these Terms. Sections 6, 9, 11 and 12 survive termination.

11. Changes to These Terms

We may update these Terms; the "last updated" date above reflects the current version. Continuing to use the app after a change means you accept it.

12. Apple App Store — Additional Terms

These terms apply if you obtained Groupy from the Apple App Store, and they take precedence over anything inconsistent above:

• Acknowledgement: this EULA is between you and Caitty only, not with Apple. Caitty, not Apple, is solely responsible for Groupy and its content.
• Scope of licence: the licence granted in section 2 is non-transferable and limited to using Groupy on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts through Family Sharing or volume purchasing.
• Maintenance and support: Caitty is solely responsible for maintenance and support. Apple has no obligation to furnish any maintenance or support services for Groupy.
• Warranty: Caitty is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Groupy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Groupy.
• Product claims: Caitty, not Apple, is responsible for addressing any claims relating to Groupy or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• Intellectual property: in the event of a third-party claim that Groupy or your possession and use of it infringes that party's intellectual property rights, Caitty, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms: you must comply with any applicable third-party terms of agreement when using Groupy, including your wireless data service agreement.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of it, have the right to enforce it against you as a third-party beneficiary.

13. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules, except where mandatory consumer law in your country of residence gives you stronger protection.
