Terms of Use

These Terms of Use ("Terms") apply to the Everen app for iPhone and iPad, provided by Caitty ("we", "us"). By downloading or using Everen you agree to these Terms and to Apple's Licensed Application End User License Agreement. If you do not agree, do not use the app.

1. The service

Everen lets you hold conversations with 100 fictional characters by text, spoken replies and live voice calls, starting from topics you choose. Characters can also send AI-generated photos when you ask. All characters are fictional adults; their names, portraits, voices, photos and replies are generated by AI. Everen does not connect you with other people and does not provide human communication services.

2. Eligibility

You must be allowed to use apps and accept these Terms where you live. If local law requires permission from a parent or guardian, get it before using Everen. Purchases require an Apple Account and are subject to the App Store's purchase controls.

3. Love Coins

• Love Coins are Everen's in-app currency. Messages, spoken replies, calls, photos and gifts use Love Coins at the price shown in the app before you use them.
• New users receive free Love Coins. Love Coin packs are optional consumable purchases made through the App Store and do not expire.
• Love Coins have no cash value, cannot be transferred or exchanged, and can only be used inside Everen on the device where they are stored. Deleting your data or the app removes your balance.
• If a spoken reply or a requested photo cannot be delivered, its Love Coins are refunded to your balance automatically.

4. Everen Premium

• Everen Premium is an optional auto-renewable subscription, offered monthly or yearly, that adds a monthly Love Coin bonus while it is active. Actions still use Love Coins at the price shown; Premium does not make usage unlimited.
• Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel the subscription in your Apple Account settings. Cancelling stops future renewals; Premium stays active until the end of the paid period.

5. Refunds and pricing

All purchases are processed by Apple, and refund requests are handled by Apple under its policies at reportaproblem.apple.com. Prices are shown in your local currency at the time of purchase and may change.

6. Acceptable use

When you write to a character, share a photo or speak in a call, you agree that you will not:

• submit unlawful, harmful, sexual, hateful or infringing content, or content that sexualises minors;
• share private information about another person or impersonate a real person;
• try to get around Everen's general-audience content policy or safety checks;
• reverse engineer the app, bypass in-app purchases or interfere with the service;
• misuse the reporting system or send knowingly false reports.

7. AI-generated content

Replies, voices and photos are generated automatically and may be inaccurate, inconsistent or out of character. They are entertainment, not professional, medical, legal or financial advice. Everen applies a general-audience content policy on its server, and you can report any reply by long-pressing it and choosing Report reply. Reports are kept for up to 90 days.

8. Intellectual property

The app, its characters, portraits, voices, copy and the Everen name and icon belong to Caitty or its licensors. Character portraits are AI-generated images of people who do not exist. Photos you take or choose remain yours; you give us permission to process them only to create the reply you asked for.

9. Termination and changes

We may suspend or end access to Everen if these Terms are broken, and we may change or discontinue features. We may update these Terms; the "Last updated" date shows the latest version, and continuing to use Everen means you accept it.

10. Disclaimers and liability

Everen is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Caitty is not liable for indirect, incidental, special or consequential damages arising from your use of Everen. Nothing in these Terms limits rights you have under consumer law that cannot be limited.
