1. Acceptance of Terms

By accessing or using Everen, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. Eligibility

You must be legally permitted to use mobile applications and agree to these Terms in your jurisdiction. If local law requires permission from a parent or guardian, you must obtain it before using Everen. In-app purchases require a valid Apple Account and are subject to the App Store's purchase controls.

3. Description of Service

Everen is an interactive storytelling app. The iOS release offers 100 curated fictional adult characters and lets users continue general-audience stories through text, spoken replies, and live voice dialogue. All character identities, portraits, voices, and responses are AI-generated fiction. They do not represent real people, and the app does not connect users with other people or provide human communication services. AI responses are narrative entertainment and should not be interpreted as professional, legal, medical, or financial advice.

4. In-App Purchases

• Stars & Unlocks: Some characters and features can be unlocked with Stars earned through normal use or purchased through the App Store.
• Premium: Optional subscriptions renew automatically through your Apple Account until cancelled in Settings → Apple Account → Subscriptions.
• Virtual Currency & Items: Stars and any unlocked content are non-refundable, non-transferable, and have no real-world value. Purchased items can only be used inside Everen.
• Refunds: All purchases are processed by Apple. Refund requests are handled by Apple under their published refund policy.
• Pricing: Prices are shown in your local currency at the time of purchase and may change.

5. Curated Characters and Generated Content

The iOS character library is selected and published by Everen. The iOS app does not provide a public user-created character service. When you write a story prompt or use live voice dialogue, you agree that:

• You will use the service for fictional, general-audience storytelling.
• You will not submit private information about another person or attempt to impersonate a real person.
• You will not submit unlawful, harmful, deceptive, or infringing content.
• You will not try to bypass the iOS catalog restrictions or server-side safety checks.

6. User Conduct

You agree not to:

• Use Everen for any unlawful purpose
• Attempt to reverse engineer, decompile, or otherwise extract source code or assets
• Bypass paid features or in-app purchase requirements
• Misuse the reporting system or submit knowingly false reports
• Interfere with the operation of our chat, voice, catalog, or ad services

7. AI-Generated Content

All characters and their replies are fictional and AI-generated, and may occasionally be inaccurate or out of character. Everen does not guarantee the accuracy, appropriateness, or tone of any individual reply. Generated dialogue is narrative entertainment and is not a substitute for qualified professional advice.

8. iOS Safety and Reporting

The iOS catalog, text generation, streaming output, spoken replies, and live voice dialogue are permanently limited to general-audience material. These limits cannot be broadened through an iOS setting or remote configuration. The Android release is maintained independently and does not alter the iOS content policy. In the iOS app, users can long-press an AI response and choose Report Response. Submitted reports are retained for moderation for up to 90 days.

9. Intellectual Property

All app content — including character portraits, copy, voices, and the Everen name and logo — is owned by us or our licensors and protected by copyright and trademark law. Character portraits are AI-generated images of people who do not exist.

10. Termination

We may suspend or terminate access to Everen at any time, with or without notice, including for violations of these Terms.

11. Disclaimer of Warranties

Everen is provided "as is" without warranties of any kind. We do not warrant that the app will be uninterrupted, error-free, or fit for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Everen.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after the "Last updated" date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Caitty is established, without regard to conflict of laws principles.
