By downloading, installing, or using NovaChat AI Chat ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

NovaChat AI Chat is a mobile application that provides AI-powered conversational services. The App offers:

• AI chat conversations with multiple personas
• Multi-language support and translation
• Free tier with limited features
• Premium subscription with enhanced features

3. Benutzerkonten und Registrierung

You may need to create an account to access certain features. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Abonnement und Zahlung

4.1 Premium-Abonnement

Premium features are available through auto-renewable subscriptions purchased via Apple's In-App Purchase system. Subscription options include weekly, monthly, and yearly plans.

4.2 Abrechnung

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings

4.3 Kostenlose Testversion

We may offer free trial periods for premium features. If you do not cancel before the trial ends, you will be charged the subscription fee.

4.4 Rückerstattungen

Refunds are handled by Apple according to their refund policy. We do not have direct control over refunds for In-App Purchases.

5. Zulässige Nutzung

You agree NOT to use the App to:

• Violate any laws or regulations
• Harass, abuse, or harm others
• Generate illegal, harmful, or offensive content
• Attempt to hack, reverse engineer, or compromise the App
• Use automated systems to access the service
• Impersonate others or misrepresent your identity
• Collect user data without permission

6. Inhalt und geistiges Eigentum

You retain ownership of the messages you send. By using the App, you grant us a limited license to process your messages to provide the AI service.

6.2 KI-generierte Inhalte

AI-generated responses are provided "as is." While we strive for accuracy, we do not guarantee the correctness, completeness, or reliability of AI-generated content.

6.3 Unser geistiges Eigentum

The App, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the App without permission.

7. Gewährleistungsausschluss

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy of AI-generated content

8. Haftungsbeschränkung

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the App
• Damages resulting from AI-generated content

Our total liability shall not exceed the amount you paid for the App in the past 12 months.

9. Kündigung

We reserve the right to suspend or terminate your access to the App at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service
• Any other reason at our discretion

You may terminate your account at any time by deleting the App and canceling your subscription.

10. Datenschutz

Your use of the App is also governed by our Datenschutzrichtlinie, which is incorporated into these Terms by reference.

11. Änderungen der Bedingungen

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Anwendbares Recht

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where our company is registered, without regard to conflict of law principles.

13. Streitbeilegung

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.
